M Ravi files lawsuits against Wong, Law Society

UPDATE at 4:50pm, Friday 20 July: From M Ravi's office: "Please note that we will not be filing the Writ today. We will instead be issuing a Letter of Demand to The Law Society of Singapore."

Lawyer M Ravi, who has been in the news lately, has filed a law suit against the Law Society of Singapore (LSS), and Mr Wong Siew Hong, who heads the sub-committee for Member Care in the LSS.

Mr Ravi is also filing a complaint against Dr Calvin Fones with the Singapore Medical Association (SMA).

The lawsuits and complaint stems from what transpired in the past week.

Dr Fones had informed the LSS, through a letter, on 16 July that he had seen Mr Ravi 2 days prior and had diagnosed him as having a “manic relapse” of his bi-polar condition. Dr Fones wrote that thus Mr Ravi was “currently unfit to practise law.”

Mr Ravi has described Dr Fones' diagnosis as "ridiculous."

Upon notification of Mr Ravi’s alleged “relapse” of his medical condition, Mr Wong – who was assigned as the liaison between Dr Fones [picture, right] and the LSS on the matter – attempted to inform the High Court on Monday, as Mr Ravi was presenting his arguments in the case on the Prime Minister’s discretionary powers to call by-elections, of Dr Fones' diagnosis.

Judge Philip Pillai met with Mr Wong, the Attorney General Chambers (AGC) and Mr Ravi in his chambers and reprimanded Mr Wong and the Law Society for having the “audacity” to appear in court without an application to be heard.

On Monday afternoon, Mr Wong made his second attempt to inform the Court of Mr Ravi’s alleged medical condition.

This time, Justice Quentin Loh was presiding over the case on several leaders of the opposition Singapore Democratic Party (SDP) for illegal assembly. In chambers, Justice Quentin Loh dismissed Mr Wong’s arguments and allowed proceedings to continue. Mr Ravi was not in Court and had Mr Louis Joseph stand in for him then.

On Tuesday morning, Mr Ravi was representing Mr Kenneth Jeyaretnam in a pre-trial conference. Mr Jeyaretnam is seeking an injunction from the Court to stop the Singapore Government from providing a US$4 billion loan to the International Monetary Fund (IMF).

Mr Wong’s 3rd attempt to stop Mr Ravi from acting for his client was in vain again – but this time because Mr Wong [picture, right] himself was late for the proceedings and had only arrived after they ended.

These events have raised widespread shock and criticisms of Mr Wong, Dr Fones and the LSS which, incidentally, said that Mr Wong had “acted on his own volition” and that he did so “with the best of intentions.”

Critics, however, charged that his actions have brought the Bar into disrepute. The Association of Criminal Lawyers of Singapore (ACLS) criticised the LSS and that the behaviour of Mr Wong had “left a very bitter taste in the mouths and has potentially brought the Bar into disrepute.”

Questions have also been raised about how a supposedly confidential and private medical report could be circulated to the Law Society by Dr Fones, and whether Mr Wong had misrepresented himself to the courts, since the LSS said that he had “acted on his own volition.” Would the courts have allowed him to be heard, since he had no locus standi in all the 3 cases which proceedings he interrupted, if he had not represented himself as a representative of the LSS?

These are some of the questions which perhaps Mr Ravi’s lawsuits will shed light on.

    Lots of posts on other sites and fb about ravi's dance performance at speakers corner today. Somehow publichouse has suddenly decided to go quiet on this news break. Why is that?

    Isn't it quite an important piece of news? At least as important than is non-story about a lawsuit that has not been filed?

    Maybe you have something coming up. It's just that public house has been very prompt in covering Ravi until now. And coincidentally it involves a story that might not paint Ravi as a hero.

    Yes, I did – the first, the last and the in-between. Yes of course it raises doubts in the minds - only that you see it from one set angle and I see it from a diametrically opposed angle. It is a vital difference in perceptions. Readers can make up their own minds, I am sure.

    Psychiatrists should never use a patient's diagnosis to stop him from functioning in his occupation, especially when there has been no lapses whatsoever in Ravi's discharging of his occupational duties in court.

    Having a mental condition is no basis for a mental health practitioner to propose that a patient's unfit for his job - if there are no threats of harm that can cause injury or death. What can Ravi do? Yes, he may behave unruly in his private life, he may even have bipolar as described, but so? Has he failed in his duties in court? Can he successfully threaten the judge or anyone in authority physically? The judge is absolutely right to rebuke Wong and to make the statement that all that he needs to know is if Ravi has a practicing law license.

    Bi-polar is a type of depression. Depression affects more adults than we know today. Many in high positions and professions have the condition as well. Can all their psychiatrists call for the removal of their patient's jobs? Wouldn't that bring about greater depression in their patients? Is that fair and right handling by a mental health practitioner?

    Bi-polar is not a threatening condition that will cause deliberate harm to others. Everyone who has the condition is encouraged to cope with it, through the friendship, support and help of their psychiatrist, psychologists, counselors, and many can indeed cope successfully. Sustaining the patient through his job successfully is one goal of every genuine practitioner. So why has such a proposal come forth from a high level practitioner from a most reputed hospital in a most controversial form, when there has been no problems at all in Ravi's job?

    If you argue, say, afraid that the worst would happen, say, Ravi behaves unruly in court - would not the court has its own security avenues to handle him? If this had been the case, it would have been completely justified to remove Ravi from his law practice. Otherwise, Dr Fones judgement seemed to have completely failed and betrayed the mental health profession, and he is in fact, perhaps the one, who should be removed from his practice for making such a big boo boo.

    Mike, what is the news break?

    Ravi has not filed a writ and only said they "will be issuing" a letter of demand.

    As far as I can tell, they have actually done nothing apart from talk, which is why I take issue with this publichouse story.

    To add to the litany of Ravi’s alleged misbehavior and misconduct incidents, so attributed to his mental state, the synergic cynic says a "Tamil current affairs producer at MediaCorp has filed a police report against Ravi for verbally abusing her during an interview with him and also a STOMP content producer can be ‘arranged’ to 'corroborate' (What is this supposed to mean?) Ravi's instability (Wow…this Sgcynic really has a trove of ready information on Ravi). Are these prelims to his final slaughter?

    The litmus test on Ravi’s mental condition is the conduct and behaviour of Ravi himself during the critical court hearing periods. He argued his cases well (and keeping cool despite highly provocative butting ins from the law society) and the judges had no issue whatsoever with him. And he was very lucid in his interview he gave to reporters outside the court at one occasion.

    So what is your beef?

    I do not know Mr Ravi personally. We have to be fair to him. Don’t pre-hang him. Let due process – without any interference whatsoever – take its course.
